FUBUKI - Limited Warranty Policy

Overview

This Limited Warranty is provided by FUBUKI and is in addition to, and does not replace, any rights or remedies you may have under applicable consumer protection laws.

Depending on where you live and where you purchased your FUBUKI product, you may have statutory rights relating to defective or non-conforming products that apply for longer than the warranty period stated below. Nothing in this Limited Warranty excludes, restricts, modifies, or limits those rights where they cannot lawfully be excluded, restricted, modified, or limited.

1. FUBUKI Limited Warranty

FUBUKI warrants that its products will be free from defects in materials and workmanship under normal and intended use for a period of one (1) year from the date of purchase.

This one-year Limited Warranty is a voluntary commercial/manufacturer warranty provided by FUBUKI. It is separate from any mandatory statutory rights you may have against the seller, manufacturer, importer, or other responsible party under applicable law.

Where applicable law provides greater or longer protection, those statutory rights remain unaffected.

2. What This Limited Warranty Covers

Subject to the terms below, this Limited Warranty covers manufacturing defects in materials and workmanship, including defects such as:

  • seam failure resulting from a manufacturing defect;
  • abnormal separation of materials resulting from a manufacturing defect; and
  • functional defects attributable to materials or workmanship.

Whether a particular issue constitutes a manufacturing defect will be assessed based on the nature of the product, its age, its condition, and its normal and intended use.

3. What This Limited Warranty Does Not Cover

This Limited Warranty does not cover damage or deterioration caused by circumstances unrelated to a defect in materials or workmanship, including:

  • normal wear and tear;
  • pilling or other surface changes resulting from normal use;
  • normal fading or discoloration resulting from use or prolonged exposure to sunlight;
  • deformation, melting, discoloration, or other damage caused by excessive heat or exposure to heat sources such as radiators, heaters, fireplaces, or open fires;
  • use of the product for a purpose for which it was not designed or intended;
  • improper or inadequate care, cleaning, storage, or maintenance;
  • misuse, abuse, negligence, or accidents;
  • alterations or modifications that cause or contribute to the defect or damage; or
  • cosmetic changes that do not affect the normal function of the product and result from ordinary use.

These exclusions apply only to the extent permitted by applicable law and do not exclude a claim where the reported problem results from a defect or lack of conformity for which FUBUKI or the seller is legally responsible.

A change of mind or buyer's remorse is not covered by this Limited Warranty. However, this does not affect any statutory cancellation, withdrawal, or return rights that may apply to your purchase.

4. Remedies Under This Limited Warranty

If a product is found to have a defect covered by this Limited Warranty, FUBUKI will, at its discretion and subject to applicable law:

  • repair the product;
  • replace the product with the same or a comparable product; or
  • provide another appropriate remedy, including a refund or credit where appropriate.

If the same product is no longer available, FUBUKI may provide a comparable replacement of similar value.

Nothing in this section limits any remedy that you are entitled to choose or receive under applicable mandatory consumer law.

5. Costs of Valid Warranty Claims

For a claim accepted under this Limited Warranty, FUBUKI will not charge the consumer for the repair or replacement itself.

Where applicable law requires FUBUKI or the seller to bear shipping, postage, transportation, handling, or other costs associated with remedying a defective or non-conforming product, those costs will not be charged to the consumer.

Please do not return a product to FUBUKI without first receiving return instructions or authorization.

6. How to Make a Claim

Products purchased directly from FUBUKI

If you purchased your product from fubukiboots.com or another FUBUKI-operated sales channel, please contact FUBUKI customer service with:

  • information identifying the product;
  • the approximate date and place of purchase;
  • reasonable proof of purchase, where available; and
  • photographs and a description of the problem where reasonably necessary to assess the claim.

FUBUKI may request that the product be returned for inspection where reasonably necessary.

Products purchased from an authorized retailer

If you purchased your FUBUKI product from an authorized retailer, you may contact the retailer regarding rights or remedies for which the retailer is responsible under applicable consumer law.

For claims specifically under this FUBUKI Limited Warranty, you may follow the warranty claim procedure communicated by FUBUKI or the retailer.

Nothing in this policy requires a consumer to pursue a manufacturer instead of a seller where applicable law gives the consumer rights against the seller.

7. Proof of Purchase

We recommend keeping your receipt, invoice, order confirmation, or other purchase documentation.

FUBUKI may request reasonable evidence showing when and where the product was purchased in order to determine whether a claim falls within this Limited Warranty.

Where applicable law permits other forms of proof of purchase, an original paper receipt will not be the exclusive means of establishing a claim.

8. Missing or Incorrect Items

If your order arrives with missing or incorrect items, please contact the seller as soon as reasonably possible after delivery.

For purchases made directly from FUBUKI, we recommend reporting missing or incorrect items within 60 days of delivery so that we can investigate the order promptly.

This 60-day notification period does not limit any longer period or remedy available under applicable consumer law.

9. Inspection of Claims

To assess a warranty claim, FUBUKI may reasonably request:

  • photographs of the product and reported defect;
  • proof or information regarding the purchase;
  • product identification information; and/or
  • return of the product for inspection.

These requirements will not be applied where they would unlawfully restrict a consumer's statutory rights.

If a return is required for an accepted claim and applicable law requires the seller or warrantor to bear the return cost, the consumer will not be charged that cost.

10. Statutory Consumer Rights

European Union

Consumers in the European Union have statutory rights relating to goods that are defective, non-conforming, or do not correspond with their description. These rights include a minimum legal guarantee period of two years from delivery under EU law, with some EU countries providing additional protection.

This FUBUKI Limited Warranty is an additional commercial warranty and does not replace or reduce those statutory rights.

Norway, Switzerland, UK

Consumers in Switzerland, Norway and the U.K. may have statutory rights concerning defective goods, including rights subject to the applicable limitation periods and the terms of the relevant sales contract.

This FUBUKI Limited Warranty is separate from those statutory rights and does not limit rights that cannot lawfully be excluded or restricted.

Canada

Consumers in Canada may have statutory warranties, conditions, guarantees, or other rights under applicable provincial or territorial law. These rights may include requirements concerning product quality, fitness for purpose, durability, conformity with descriptions, and hidden or latent defects.

In some provinces, these statutory protections may apply for a reasonable product lifetime rather than a fixed warranty period.

This FUBUKI Limited Warranty is in addition to any rights that cannot lawfully be excluded or restricted.

United States

This Limited Warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

To the extent required by applicable federal or state law, nothing in this Limited Warranty excludes or limits implied warranties or other consumer rights that cannot lawfully be excluded or limited.

Some states do not allow certain limitations or exclusions of incidental or consequential damages or limitations on the duration of implied warranties. Accordingly, any such limitation or exclusion applies only to the extent permitted by applicable law.

11. General

This Limited Warranty applies only to the extent permitted by applicable law.

If any provision of this Limited Warranty conflicts with a mandatory consumer protection law applicable to your purchase, the mandatory consumer protection law will apply and the remaining provisions of this Limited Warranty will remain in effect to the extent permitted by law.

No provision of this Limited Warranty is intended to waive, exclude, restrict, or modify a consumer right or remedy that cannot legally be waived, excluded, restricted, or modified.
